    Energy Regulatory Experience

  • Our firm represents and advise small energy developers, municipalities and trade associations before federal courts, the Federal Energy Regulatory Commission, state utility commissions and state courts on all aspects of electric utility regulation, hydroelectric licensing and renewable energy development.

  • Our firm has participated in hydroelectric licensing and relicensing proceedings at the FERC, including a competitive relicensing and preliminary permit proceedings. We have represented a variety of clients in these matters, including municipal and private applicants as well as affected intervenors. We have also defended developers in civil enforcement proceedings brought by FERC and have succeeded in vacating or reducing six figure penalties by up to 95 percent of the amount originally proposed.

  • Our firm has expertise in renewable energy development, specifically ocean energy development. We have advised several ocean energy clients on applicable federal and state laws and regulations, grant and incentive programs, including the Renewable Portfolio Standard, tax credit, net metering programs and state and federal grant programs. We have also worked with various renewable developers to locate public and private sources of funding.

  • We have first hand experience with the following issues and procedures in the electric utility industry: FERC open access tariff, ISO's, RTO's, state specific deregulation legislation and stranded cost proceedings, electric utility mergers and antitrust issues, asset divestiture. energy and regulatory practice, litigation.

    Litigation Experience

  • We have briefed and argued cases before the United States Court of Appeals for the D.C. Circuit, the D.C. Circuit, the Federal Circuit and the Second Circuit and consulted and advised on appellate matters in other federal and state appellate courts. While a good portion of our appellate work has involved regulatory or energy matters, we have also handled appeals addressing criminal matters, Section 1983 civil rights violations, engineering malpractice, evidentiary issues, contract, tort and damages and pre-judgment interest issues.

  • We have represented clients in criminal and civil litigation matters on a variety of issues, including employment discrimination, civil rights, breach of contract, jurisdictional challenges and criminal, from motions practice to jury trials in D.C. Superior Court as well as federal court.

  • Our firm has represented clients in administrative proceedings before the Federal Energy Regulatory Commission, public benefits agencies and the Merit Systems Protection Board.

  • We have successfully assisted clients in recovering attorneys fees through fee shifting statutes such as the Equal Access to Justice Act or review of insurance policies and negotiation of defense cost coverage.
    Law and Technology Issues

  • Our firm has an active interest in law and technology issues, ranging from use of technology such as free on-line research tools or electronic communication to reduce costs to our clients and improve service, on-line to court's electronic filing initiatives to copyright of attorneys' electronically filed legal briefs. We have written several articles on these topics and received press coverage on these issues, which can be viewed in the Articles & Press section of our website.
